Article L6211-3-1 of the French Public Health Code

Screening for transmissible infectious diseases by means of a rapid diagnostic test may be carried out on a minor by staff from the structures mentioned in the third paragraph of article L. 6211-3.

Notwithstanding article 371-1 of the Civil Code , the staff mentioned in the first paragraph of this article may dispense with obtaining the consent of the holder(s) of parental authority when this screening is necessary to safeguard the health of a minor who expressly opposes consultation with the holder(s) of parental authority in order to keep his/her state of health secret. However, such staff must first endeavour to obtain the minor’s consent to such consultation. If the minor maintains his or her opposition, the staff may carry out the screening. In this case, the minor must be accompanied by an adult of his or her choice.

Article L6211-3-1

Le dépistage de maladies infectieuses transmissibles au moyen d’un test rapide d’orientation diagnostique peut être réalisé sur une personne mineure par du personnel des structures mentionnées au troisième alinéa de l’article L. 6211-3.

Par dérogation à l’ article 371-1 du code civil , le personnel mentionné au premier alinéa du présent article peut se dispenser d’obtenir le consentement du ou des titulaires de l’autorité parentale lorsque ce dépistage s’impose pour sauvegarder la santé d’une personne mineure et qui s’oppose expressément à la consultation du ou des titulaires de l’autorité parentale afin de garder le secret sur son état de santé. Toutefois, ce personnel doit, dans un premier temps, s’efforcer d’obtenir le consentement du mineur à cette consultation. Dans le cas où le mineur maintient son opposition, ce personnel peut mettre en œuvre le dépistage. Dans ce cas, le mineur se fait accompagner d’une personne majeure de son choix.
