Article L6223-3 of the French Public Health Code

The company operating a private medical biology laboratory is registered :

1° On the roll of the Order of Physicians in accordance with the terms and conditions laid down in Chapter II of Title I of Book I of Part Four, where at least one medical biologist holds a fraction of the share capital of the company operating the laboratory;

2° On the register of pharmacists in accordance with the terms and conditions laid down in Chapter II of Title II of Book II of Part Four, where at least one pharmacist-biologist holds a fraction of the share capital of the company operating the laboratory.

The application for registration with the Order shall include details of the legal and financial structure and general organisation of the medical biology laboratory.

The legal representative of the laboratory is required to comply with the disclosure obligations set out in article L. 4113-9, when at least one medical biologist holds a fraction of the share capital of the company running the laboratory, and with the disclosure obligations set out in article L. 4221-19, when at least one pharmacist biologist holds a fraction of the share capital of the company running the laboratory.

Article L6223-3

La société qui exploite un laboratoire de biologie médicale privé est inscrite :

1° Au tableau de l’ordre des médecins suivant les modalités et les conditions prévues au chapitre II du titre Ier du livre Ier de la quatrième partie, lorsqu’au moins un médecin biologiste détient une fraction du capital social de la société exploitant le laboratoire ;

2° Au tableau de l’ordre des pharmaciens suivant les modalités et les conditions prévues au chapitre II du titre II du livre II de la quatrième partie, lorsqu’au moins un pharmacien biologiste détient une fraction du capital social de la société exploitant le laboratoire.

La demande d’inscription à l’ordre comporte les éléments relatifs à la structure juridique et financière ainsi qu’à l’organisation générale du laboratoire de biologie médicale.

Le représentant légal du laboratoire est tenu au respect des obligations de communication prévues à l’article L. 4113-9, lorsqu’au moins un médecin biologiste détient une fraction du capital social de la société exploitant le laboratoire, et aux obligations de communication prévues à l’article L. 4221-19, lorsqu’au moins un pharmacien biologiste détient une fraction du capital social de la société exploitant le laboratoire.
