Article L624-3-1 of the French Commercial code

Decisions by the official receiver to admit or reject claims or to decline jurisdiction are recorded on a statement that is filed at the court registry. Any interested person, with the exception of those mentioned in Article L. 624-3, may lodge a complaint with the official receiver under conditions set by decree in the Conseil d’Etat.

People who are co-obligated or who have granted a personal guarantee or who have assigned or transferred an asset as security, when they are sued, may not have the statement of claims set against them when they have not been notified of the admission decision provided for in Article L. 624-2.

Article L624-3-1

Les décisions d’admission ou de rejet des créances ou d’incompétence prononcées par le juge-commissaire sont portées sur un état qui est déposé au greffe du tribunal. Toute personne intéressée, à l’exclusion de celles mentionnées à l’article L. 624-3, peut former une réclamation devant le juge-commissaire dans des conditions fixées par décret en Conseil d’Etat.

Les personnes coobligées ou ayant consenti une sûreté personnelle ou ayant affecté ou cédé un bien en garantie, lorsqu’elles sont poursuivies, ne peuvent se voir opposer l’état des créances lorsque la décision d’admission prévue à l’article L. 624-2 ne leur a pas été notifiée.
