Article L626-29 of the French Commercial code

The provisions of this section are applicable to companies which reach thresholds set by decree in the Conseil d’Etat.

They also apply to companies which own or control another company, within the meaning of Articles L. 233-1 and L. 233-3, provided that all the companies concerned reach thresholds set by decree in the Conseil d’Etat.

The thresholds provided for in the two preceding paragraphs are defined by reference either to the number of employees and the net turnover of these companies or firms, or to their net turnover.
At the request of the debtor, the juge-commissaire may authorise the application of the provisions below this threshold.

The provisions of this section do not prevent the application of the provisions of this chapter which do not conflict with them.

Les dispositions de la présente section sont applicables aux entreprises qui atteignent des seuils fixés par décret en Conseil d’Etat.

Elles s’appliquent également aux sociétés qui détiennent ou contrôlent une autre société, au sens des articles L. 233-1 et L. 233-3, dès lors que l’ensemble des sociétés concernées atteignent des seuils fixés par décret en Conseil d’Etat.

Les seuils prévus aux deux alinéas précédents sont définis par référence soit au nombre de salariés et au montant net du chiffre d’affaires de ces entreprises ou sociétés soit au montant net de leur chiffre d’affaires.

A la demande du débiteur, le juge-commissaire peut autoriser qu’il en soit également fait application en deçà de ce seuil.

Les dispositions de la présente section ne font pas obstacle à l’application des dispositions du présent chapitre qui ne leur sont pas contraires.
