Article L626-30-1 of the French Commercial code

The right of an affected party to vote in a class constitutes an accessory to the claim arising prior to the judgment opening the proceedings and is transferred ipso jure to its successive holders notwithstanding any clause to the contrary.

The holder of the transferred claim shall only be informed of the debtor’s proposals and allowed to cast a vote from the day on which the administrator is informed of the transfer in accordance with the procedures laid down by decree in the Conseil d’Etat.

The creditor whose claim has been transferred shall be informed of the debtor’s proposals and allowed to cast a vote from the day on which the administrator is informed of the transfer in accordance with the procedures laid down by decree in the Conseil d’Etat.
A creditor whose claim is extinguished or transferred loses the status of affected party.

Le droit d’une partie affectée de voter dans une classe constitue un accessoire de la créance née antérieurement au jugement d’ouverture de la procédure et se transmet de plein droit à ses titulaires successifs nonobstant toute clause contraire.

Le titulaire de la créance transférée n’est informé des propositions du débiteur et admis à exprimer un vote qu’à compter du jour où le transfert a été porté à la connaissance de l’administrateur selon des modalités prévues par décret en Conseil d’Etat.

Le créancier dont la créance est éteinte ou transmise perd la qualité de partie affectée.
