In the absence of an international agreement concluded by the European Union with one or more non-member States of the European Union relating to the arrangements for cooperation between the resolution authorities and the counterpart authorities of non-member States of the European Union, concerning in particular preventive recovery plans and preventive resolution plans, the Autorité de contrôle prudentiel et de résolution may conclude cooperation agreements with the supervisory and resolution authorities of these States under the conditions set out in Article L. 632-7.
These agreements shall comply, where applicable, with the framework agreements concluded by the European Banking Authority in this area with the relevant authorities of non-EU Member States.
The conditions for the application of this article are set by decree in the Conseil d’Etat, in particular the conditions under which the conclusion of the agreements mentioned above involves the supervisory and resolution colleges according to their respective competencies.
