Article L632-5 of the French Code governing the entry and residence of foreign nationals and the right of asylum

An application for the repeal of an expulsion decision made more than two months after notification of the decision may only be granted if the foreign national resides outside France. This condition does not apply:
1° For the implementation of article L. 632-6;
2° During the time when the foreign national is serving a fixed prison sentence in France;
3° When the foreign national is the subject of a house arrest decision taken pursuant to articles L. 731-3, L. 731-4 or L. 731-5.

Article L632-5

Il ne peut être fait droit à une demande d’abrogation d’une décision d’expulsion présentée plus de deux mois après la notification de cette décision que si le ressortissant étranger réside hors de France. Cette condition ne s’applique pas :
1° Pour la mise en œuvre de l’article L. 632-6 ;
2° Pendant le temps où le ressortissant étranger subit en France une peine d’emprisonnement ferme ;
3° Lorsque l’étranger fait l’objet d’une décision d’assignation à résidence prise en application des articles L. 731-3, L. 731-4 ou L. 731-5.
