Article L6323-1-3 of the French Public Health Code

I.-Health centres are created and managed either by non-profit organisations, or by départements, or by municipalities or their groupings, or by public health establishments, or by legal entities managing private health establishments, whether non-profit or for-profit.

A health centre may also be set up and managed by a société coopérative d’intérêt collectif governed by Title II ter of law no. 47-1775 of 10 September 1947 on the status of cooperation. In this case, notwithstanding article 19 septies of this law, the only legal entities that may be members of the société coopérative d’intérêt collectif are those mentioned in the first paragraph of this I.

II – The manager of a health centre may not hold a managerial position within the management structure if he/she has a direct or indirect interest in private companies providing remunerated services to the management structure.

I.-Les centres de santé sont créés et gérés soit par des organismes à but non lucratif, soit par les départements, soit par les communes ou leurs groupements, soit par des établissements publics de santé, soit par des personnes morales gestionnaires d’établissements privés de santé, à but non lucratif ou à but lucratif.

Un centre de santé peut également être créé et géré par une société coopérative d’intérêt collectif régie par le titre II ter de la loi n° 47-1775 du 10 septembre 1947 portant statut de la coopération. Dans une telle hypothèse, par dérogation à l’article 19 septies de cette loi, les seules personnes morales pouvant être associées de la société coopérative d’intérêt collectif sont les personnes mentionnées au premier alinéa du présent I.

II.-Le dirigeant d’un centre de santé ne peut exercer de fonction dirigeante au sein de la structure gestionnaire lorsqu’il a un intérêt, direct ou indirect, avec des entreprises privées délivrant des prestations rémunérées à la structure gestionnaire.
