The local authority’s liability is eliminated or mitigated when a State authority has replaced the president of the territorial council in implementing police measures, in circumstances or under conditions not provided for by law.

La collectivité voit sa responsabilité supprimée ou atténuée lorsqu’une autorité relevant de l’Etat s’est substituée, dans des hypothèses ou selon des modalités non prévues par la loi, au président du conseil territorial pour mettre en oeuvre des mesures de police.
