Article L6364-5 of the French General Code of Local Authorities

In application of article LO 6371-5, a global grant for school construction and equipment is instituted in order to contribute to compensating for the net increases in charges for the collectivity of Saint-Martin resulting from the transfer of powers to it.

In 2008, its amount is 2,653,706 euros. This amount corresponds to the average annual amount of funding allocated by the Guadeloupe region to the lycée on Saint-Martin and by the Guadeloupe department to the collèges on Saint-Martin between 1997 and 2006 inclusive; this amount incorporates indexation following the application of the growth rate for gross fixed capital formation of general government associated with the 2007 and 2008 Finance Bills.

In 2009, the amount allocated to the local authority of Saint-Martin is equivalent to that for 2008.

In 2010, the rate used for indexation of the allocation accruing to the territorial authority of Saint-Martin is 1.2%.

From 2011, the amount allocated to the territorial collectivity of Saint-Martin is equivalent to that of 2010.

The global grant for school construction and equipment is paid in a single instalment at the end of the third quarter of the current year.

The grant is entered in the budget of the overseas collectivity of Saint-Martin, which allocates it to the reconstruction, major repairs, equipment and extension of the lycée and collèges located on its territory and to the construction of new lycées or collèges.

En application de l’article LO 6371-5, une dotation globale de construction et d’équipement scolaire est instituée afin de contribuer à compenser les accroissements nets de charges de la collectivité de Saint-Martin résultant des transferts de compétences à son profit.

En 2008, son montant s’élève à 2 653 706 euros. Ce montant correspond au montant annuel moyen des crédits consacrés par la région Guadeloupe au lycée de Saint-Martin et par le département de la Guadeloupe aux collèges de Saint-Martin entre 1997 et 2006 inclus ; ce montant intègre l’indexation consécutive à l’application du taux de croissance de la formation brute de capital fixe des administrations publiques associé aux projets de loi de finances pour 2007 et 2008.

En 2009, le montant alloué à la collectivité de Saint-Martin est équivalent à celui de 2008.

En 2010, le taux retenu pour l’indexation de la dotation revenant à la collectivité territoriale de Saint-Martin est de 1,2 %.

A compter de 2011, le montant alloué à la collectivité territoriale de Saint-Martin est équivalent à celui de 2010.

La dotation globale de construction et d’équipement scolaire est versée en une seule fois à la fin du troisième trimestre de l’année en cours.

La dotation est inscrite au budget de la collectivité d’outre-mer de Saint-Martin, qui l’affecte à la reconstruction, aux grosses réparations, à l’équipement, à l’extension du lycée et des collèges situés sur son territoire et à la construction de nouveaux lycées ou collèges.
