A foreign national who applies to the administrative court for the annulment of the decision requiring him or her to leave French territory may accompany his or her appeal with a request to suspend its enforcement, without prejudice to the provisions of 1° of article L. 761-3.
As a result, articles L. 614-1 to L. 614-18, with the exception of article L. 614-13, are not applicable in Guadeloupe. However, the provisions of the first two paragraphs of article L. 614-11 are applicable to the holding of the hearing mentioned in the second paragraph of article L. 522-1 of the Code of Administrative Justice when the foreigner has applied to the administrative court for suspension on the basis of article L. 521-2 of the same code.
