Article L654-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of this book in the Wallis and Futuna Islands:
1° The references to the judicial court of the administrative centre of the department are replaced by references to the court of first instance;
2° The references to the Republic of Iceland, the Principality of Liechtenstein, the Kingdom of Norway and the Swiss Confederation are deleted;
3° In article L. 611-1:
a) In 6°, the words: “has disregarded article L. 5221-5 of the Labour Code” are replaced by the words: “has failed to comply with the locally applicable provisions relating to the employment of foreign workers”;
b) After 6°, the following 7° and 8° are added:
” 7° The foreign national has been the subject of a final conviction for forgery, falsification, establishment under a name other than his or her own or lack of a residence permit;
” 8° The foreign national cannot prove that he or she entered the Wallis and Futuna Islands legally or remained there beyond the period of validity of his or her visa or the authorised period of stay without a visa, unless he or she holds a valid residence permit for the Wallis and Futuna Islands. “c) After the last paragraph, the following paragraph is inserted:
“When the foreign national is admitted to stay in another part of French territory, the decision mentioned in the first paragraph only covers the territory of the Wallis and Futuna Islands. “
4° The provisions of the first paragraph of Article L. 614-11 do not apply;
5° In Article L. 615-1, the provisions of 1° do not apply;
6° The sixth paragraph of Article L. 632-1 is replaced by two paragraphs worded as follows:
” c) A councillor of the administrative court with territorial jurisdiction;
” d) A person appointed by mutual agreement between the president of the court of first instance and the president of the administrative court referred to in c. “;
7° In article L. 632-2, the words: “Law no. 91-647 of 10 July 1991 relating to legal aid” are replaced by the words: “Order no. 92-1147 of 12 October 1992 relating to legal aid in criminal matters in New Caledonia and the Wallis and Futuna Islands”.

Article L654-2

Pour l’application du présent livre dans les îles Wallis et Futuna :
1° Les références au tribunal judiciaire du chef-lieu du département sont remplacées par les références au tribunal de première instance ;
2° Les références à la République d’Islande, à la Principauté du Liechtenstein, au Royaume de Norvège et à la Confédération suisse sont supprimées ;
3° A l’article L. 611-1 :
a) Au 6°, les mots : ” a méconnu l’article L. 5221-5 du code du travail ” sont remplacés par les mots : ” a méconnu les dispositions applicables localement relatives à l’emploi de la main d’œuvre étrangère ” ;
b) Après le 6°, sont ajoutés un 7° et un 8° ainsi rédigés :
” 7° L’étranger a fait l’objet d’une condamnation définitive pour contrefaçon, falsification, établissement sous un autre nom que le sien ou défaut de titre de séjour ;
” 8° L’étranger ne peut justifier être entré régulièrement dans les îles Wallis et Futuna ou s’y est maintenu au-delà de la durée de validité de son visa ou de la durée de séjour autorisée sans visa, à moins qu’il ne soit titulaire d’un titre de séjour en cours de validité pour les îles Wallis et Futuna. ” ;
c) Après le dernier alinéa, il est inséré un alinéa ainsi rédigé :
” Lorsque l’étranger est admis à séjourner dans une autre partie du territoire français, la décision mentionnée au premier alinéa ne porte que sur le territoire des îles Wallis et Futuna. ” ;
4° Les dispositions du premier alinéa de l’article L. 614-11 ne sont pas applicables ;
5° A l’article L. 615-1, les dispositions du 1° ne sont pas applicables ;
6° Le sixième alinéa de l’article L. 632-1 est remplacé par deux alinéas ainsi rédigés :
” c) D’un conseiller du tribunal administratif territorialement compétent ;
” d) D’une personnalité désignée d’un commun accord par le président du tribunal de première instance et par le président du tribunal administratif mentionné au c. ” ;
7° A l’article L. 632-2, les mots : ” la loi n° 91-647 du 10 juillet 1991 relative à l’aide juridique ” sont remplacés par les mots : ” l’ordonnance n° 92-1147 du 12 octobre 1992 relative à l’aide juridictionnelle en matière pénale en Nouvelle-Calédonie et dans les îles Wallis et Futuna “.
