Article L670-1-1 of the French Commercial code

This Title also applies to natural persons domiciled in the Moselle, Bas-Rhin and Haut-Rhin départements who have set up an appropriated asset in accordance with article L. 526-7 and whose agricultural, commercial, craft or self-employed activity is carried out exclusively with appropriation of assets.

Unless otherwise provided, references made to the person, the debtor, the contract and the co-contractor mean, respectively:

– the person as the holder of an unallocated patrimony;

– the debtor as the holder of an unallocated patrimony;

– the contract entered into by the debtor so defined;

– the co-contractor having entered into such a contract with him.

The provisions which concern the property, rights or obligations of the persons mentioned in the first paragraph must, unless otherwise provided, be understood as referring to the elements of the unaffected patrimony alone. The provisions concerning the rights or obligations of the creditors of such persons shall apply, unless otherwise provided, within the limits of the unaffected patrimony only.

Le présent titre est également applicable aux personnes physiques domiciliées dans les départements de la Moselle, du Bas-Rhin et du Haut-Rhin ayant constitué un patrimoine affecté conformément à l’article L. 526-7 et dont l’activité agricole, commerciale, artisanale ou indépendante est exclusivement exercée avec affectation de patrimoine.

Sauf dispositions contraires, les références faites à la personne, au débiteur, au contrat et au cocontractant s’entendent, respectivement :

― de la personne en tant que titulaire d’un patrimoine non affecté ;

― du débiteur en tant que titulaire d’un patrimoine non affecté ;

― du contrat passé par le débiteur ainsi défini ;

― du cocontractant ayant conclu avec lui un tel contrat.

Les dispositions qui intéressent les biens, droits ou obligations des personnes mentionnées au premier alinéa doivent, sauf dispositions contraires, être comprises comme visant les éléments du seul patrimoine non affecté. Les dispositions qui intéressent les droits ou obligations des créanciers de ces personnes s’appliquent, sauf dispositions contraires, dans les limites du seul patrimoine non affecté.
