Article L691-3 of the French Commercial code

The court shall rule on challenges raised or applications made, in accordance with paragraphs 7 or 8 of Article 36 of the aforementioned Regulation (EU) No 2015/848, by the local creditors of an establishment of the debtor located within the territory of another Member State in order to obtain compliance with the undertaking given by the judicial representative or its conformity with the applicable law or to obtain for those purposes any appropriate measure.

The judgment may be appealed against by the court-appointed agent, the debtor in possession, the applicant local creditor or the public prosecutor.

Le tribunal statue sur les contestations élevées ou les demandes présentées, conformément aux paragraphes 7 ou 8 de l’article 36 du règlement (UE) n° 2015/848 précité, par les créanciers locaux d’un établissement du débiteur situé sur le territoire d’un autre Etat membre pour obtenir le respect de l’engagement pris par le mandataire de justice ou sa conformité à la loi applicable ou pour obtenir à ces fins toute mesure adéquate.


Le jugement peut faire l’objet d’un appel de la part du mandataire de justice, du débiteur non dessaisi, du créancier local demandeur ou du ministère public.
