Article L692-8 of the French Commercial code

I.-The insolvency practitioner in the main insolvency proceedings shall apply to the president of the specially designated commercial court or the competent judicial court within whose jurisdiction the establishment is located for the purpose of verifying the conditions for approval of the undertaking.

The undertaking may only be executed in accordance with the order issued by the president.

II.-The opening of secondary insolvency proceedings may no longer be requested after the expiry of the period of thirty days from notification of the order.

I.-Le praticien de l’insolvabilité de la procédure d’insolvabilité principale saisit par requête le président du tribunal de commerce spécialement désigné ou du tribunal judiciaire compétent dans le ressort duquel est situé l’établissement aux fins de vérifier les conditions d’approbation de l’engagement.


L’engagement ne peut être exécuté qu’au visa de l’ordonnance rendue par le président.


II.-L’ouverture d’une procédure d’insolvabilité secondaire ne peut plus être demandée à l’expiration du délai de trente jours à compter de la notification de l’ordonnance.
