Article L694-6 of the French Commercial code

The official receiver shall authorise the court-appointed agent to accept or refuse inclusion in a coordination procedure of the insolvency proceedings in which he is appointed, as well as to apply to participate voluntarily in the coordination procedure. The decision is not subject to appeal.

The authorisation of the official receiver is also required to sign the mutual agreement provided for in Article 66(2) of the aforementioned Regulation (EU) 2015/848.

Article L694-6

Le juge-commissaire autorise le mandataire de justice à accepter ou refuser l’inclusion dans une procédure de coordination de la procédure d’insolvabilité dans laquelle il est désigné, ainsi qu’à demander à participer volontairement à la procédure de coordination. La décision n’est pas susceptible de recours.

L’autorisation du juge-commissaire est également nécessaire pour signer l’accord mutuel prévu au paragraphe 2 de l’article 66 du règlement (UE) n° 2015/848 précité.
