Article L722-12 of the French Intellectual Property Code

During the period of withholding referred to in Article L. 722-9 and in the second paragraph of I of l’article L. 722-11, the person authorised to use a geographical indication or the body for the defence of geographical indications may, at their request or at the request of the customs administration, inspect the goods detained.

When inspecting the goods detained, the customs authorities may take samples. At the request of the person authorised to use the geographical indication or the body for the defence of geographical indications, these samples may be handed over to him or her solely for the purposes of analysis and with a view to facilitating any actions that he or she may have to take through civil or criminal proceedings.

Pendant le délai de la retenue mentionnée à l’article L. 722-9 et au second alinéa du I de l’article L. 722-11, la personne autorisée à utiliser une indication géographique ou l’organisme de défense des indications géographiques peut, à sa demande ou à la demande de l’administration des douanes, inspecter les marchandises retenues.


Lors du contrôle des marchandises mises en retenue, l’administration des douanes peut prélever des échantillons. A la demande de la personne autorisée à utiliser l’indication géographique ou de l’organisme de défense des indications géographiques, ces échantillons peuvent lui être remis aux seules fins d’analyse et en vue de faciliter les actions qu’elle ou il peut être amené à engager par la voie civile ou pénale.
