Article L734-2 of the French Monetary and Financial Code

I.- Are applicable in the Wallis and Futuna Islands, subject to the adaptation provisions provided for in II and III, the provisions of the articles mentioned in the left-hand column of the table below, in the wording indicated in the right-hand column of the same table:

II.-For the application of I:

1° (Repealed) ;

2° If one of the payment service providers is located in Wallis and Futuna and the other in mainland France, the overseas departments, the Department of Mayotte, Saint-Barthélemy, Saint-Martin or Saint-Pierre-et-Miquelon, for the application of I of Article L. 133-13, the words “at the end of the first business day” are replaced by the words “at the end of the fourth business day”;

3° Article L. 131-32 is amended as follows:

a) The second and third paragraphs are worded as follows:

“Cheques issued and payable in the Wallis and Futuna Islands must be presented within eight days.

“Cheques issued outside the Wallis and Futuna Islands and payable in this territory must be presented within seventy days;

b) In the last paragraph, the words “in the second paragraph” are replaced by the words “in the second and third paragraphs”;

4° In the Wallis and Futuna Islands, the information provided for in the first paragraph of Article L. 131-85 is provided by the Institut d’émission d’outre-mer, which receives from the Banque de France the information it holds on the persons mentioned in Article L. 131-72 and in the second paragraph of Article L. 163-6 ;

III – The conditions for application of this article are set by decree in the Conseil d’Etat.

II.-Pour l’application du I :

1° (Abrogé) ;

2° Si l’un des prestataires de services de paiement est situé à Wallis-et-Futuna et l’autre sur le territoire de la France métropolitaine, dans les départements d’outre-mer, dans le Département de Mayotte, à Saint-Barthélemy, à Saint-Martin ou à Saint-Pierre-et-Miquelon, pour l’application du I de l’article L. 133-13, les mots : “à la fin du premier jour ouvrable sont remplacés par les mots : “à la fin du quatrième jour ouvrable ;

3° L’article L. 131-32 est ainsi modifié :

a) Les deuxième et troisième alinéas sont ainsi rédigés :

“Le chèque émis et payable dans les îles Wallis et Futuna doit être présenté dans un délai de huit jours.

“Le chèque émis hors des îles Wallis et Futuna et payable dans ce territoire doit être présenté dans un délai de soixante-dix jours.” ;

b) Au dernier alinéa, les mots : “au deuxième alinéa” sont remplacés par les mots : “aux deuxième et troisième alinéas” ;

4° Dans les îles Wallis et Futuna, l’information prévue au premier alinéa de l’article L. 131-85 est assurée par l’Institut d’émission d’outre-mer, qui reçoit de la Banque de France les informations qu’elle détient sur les personnes mentionnées à l’article L. 131-72 et au deuxième alinéa de l’article L. 163-6 ;

III.-Les conditions d’application du présent article sont fixées par décret en Conseil d’Etat.
