Article L752-1-1 of the French Commercial code

As an exception to article L. 752-1, the projects mentioned in 1° to 6° of the same article L. 752-1 which are not considered to result in artificialisation of the land within the meaning of V of article L. 752-6 and which are planned to be set up in an area covered by an operation to revitalise the area defined in I of article L. 303-2 of the French Construction and Housing Code, which includes a town centre identified by the agreement for the said operation, are not subject to authorisation for commercial use.

This agreement may, however, make authorisation for commercial use subject to the agreement for the revitalisation of the area defined in I of article L. 303-2 of the French Construction and Housing Code.
This agreement may, however, make the projects referred to in 1° to 6° of article L. 752-1 of this code subject to retail development consent if their sales area exceeds a threshold set by the agreement, which may not be less than 5,000 square metres or, in the case of predominantly food shops, 2,500 square metres.

The conditions for advertising the projects referred to in 1° to 6° of article L. 752-1 of this code are set out in the agreement.
The conditions for publicising the projects referred to in the first paragraph of this article are laid down by decree in the Council of State.

Article L752-1-1

Par dérogation à l’article L. 752-1, les projets mentionnés aux 1° à 6° du même article L. 752-1 qui ne sont pas considérés comme engendrant une artificialisation des sols au sens du V de l’article L. 752-6 et dont l’implantation est prévue dans un secteur d’intervention d’une opération de revitalisation de territoire définie au I de l’article L. 303-2 du code de la construction et de l’habitation, comprenant un centre-ville identifié par la convention de ladite opération, ne sont pas soumis à autorisation d’exploitation commerciale.


Cette convention peut toutefois soumettre à autorisation d’exploitation commerciale les projets mentionnés aux 1° à 6° de l’article L. 752-1 du présent code dont la surface de vente dépasse un seuil qu’elle fixe et qui ne peut être inférieur à 5 000 mètres carrés ou, pour les magasins à prédominance alimentaire, à 2 500 mètres carrés.


Les conditions de publicité des projets mentionnés au premier alinéa du présent article sont fixées par décret en Conseil d’Etat.
