Article L753-13 of the French Monetary and Financial Code

I.- Subject to the provisions of II and III, the provisions of the articles mentioned in the left-hand column of the following table shall apply in French Polynesia, in the wording indicated in the right-hand column of the same table:

II.-For the application of I:
1° References to the units mentioned in the Article L. 229-7 of the Environment Code do not apply;
2° References to Regulation EU No 909/2014 of the European Parliament and of the Council of 23 July 2014 are replaced by references to Articles L. 712-7 and L. 712-9.
III.-For the application of the articles mentioned in the table above:
1° In Article L. 321-1, after the words: “Banque de France”, the following words are added: “as well as the Institut d’émission d’outre-mer”;
2° In Article L. 321-2, 8 is worded as follows:
” 8. The credit rating service consisting of issuing an opinion by applying a previously defined and established classification system providing for different rating categories, concerning the credit quality of an entity, a debt or financial obligation, a debt security, a preference share or other financial instrument, or of an issuer of such a debt or financial obligation, such a debt security, such preference shares or such a financial instrument. ”
3° In Article L. 321-4, the words “and L. 312-21-1” are deleted.

Article L753-13

I.-Sont applicables en Polynésie française, sous réserve des dispositions prévues au II et au III, les dispositions des articles mentionnés dans la colonne de gauche du tableau ci-après, dans leur rédaction indiquée dans la colonne de droite du même tableau :

II.-Pour l’application du I :
1° Les références aux unités mentionnées à l’article L. 229-7 du code de l’environnement ne sont pas applicables ;
2° Les références au règlement UE n° 909/2014 du Parlement européen et du Conseil du 23 juillet 2014 sont remplacées par les références aux articles L. 712-7 et L. 712-9.
III.-Pour l’application des articles mentionnés dans le tableau ci-dessus :
1° A l’article L. 321-1, après les mots : « Banque de France » sont ajoutés les mots : « ainsi qu’à l’Institut d’émission d’outre-mer » ;
2° A l’article L. 321-2, le 8 est ainsi rédigé :
« 8. Le service de notation de crédit consistant à émettre un avis par application d’un système de classification préalablement défini et établi prévoyant différentes catégories de notation, concernant la qualité de crédit d’une entité, d’une dette ou obligation financière, d’un titre de créance, d’action privilégiée ou autre instrument financier, ou d’un émetteur d’une telle dette ou obligation financière, d’un tel titre de créance, de telles actions privilégiées ou d’un tel instrument financier. » ;
3° A l’article L. 321-4, les mots : « et L. 312-21-1 » sont supprimés.
