Article L754-11 of the French Monetary and Financial Code

I.- Subject to the provisions of II, the provisions of the article mentioned in the left-hand column of the table below, in the wording indicated in the right-hand column of the same table, shall apply in the Wallis and Futuna Islands:

II.-For the application of the articles mentioned in the table above, the first and second paragraphs of Article L. 317-1 are replaced by the following provisions:
“The officials of the Institut d’émission d’outre-mer are qualified to carry out, in the performance of their duties, the search for and the recording by official report of infringements of the provisions of Articles L. 312-1-1, L. 312-1-2, L. 314-12, L. 314-13 and L. 315-6 to L. 315-8 of this Code.
“The authorised officials mentioned in the first paragraph are also competent to investigate and record breaches of the provisions of Articles L. 312-1-1, L. 312-1-2, L. 314-12, L. 314-13 and L. 315-6 to L. 315-8 committed by the agents and branches of payment service providers with their registered office or central administration abroad located in France, Saint Pierre and Miquelon, New Caledonia, French Polynesia or the Wallis and Futuna Islands.

Article L754-11

I.-Sont applicables dans les îles Wallis et Futuna, sous réserve des dispositions prévues au II, les dispositions de l’article mentionné dans la colonne de gauche du tableau ci-après, dans sa rédaction indiquée dans la colonne de droite du même tableau :

II.-Pour l’application des articles mentionnés dans le tableau ci-dessus, les premier et deuxième alinéas de l’article L. 317-1 sont remplacés par les dispositions suivantes :
« Les agents de l’Institut d’émission d’outre-mer sont qualifiés pour procéder dans l’exercice de leurs fonctions à la recherche et à la constatation par procès-verbal des infractions aux dispositions des articles L. 312-1-1, L. 312-1-2, L. 314-12, L. 314-13 et L. 315-6 à L. 315-8 du présent code.
« Les fonctionnaires habilités mentionnés au premier alinéa sont également compétents pour rechercher et constater les infractions aux dispositions des articles L. 312-1-1, L. 312-1-2, L. 314-12, L. 314-13 et L. 315-6 à L. 315-8 commises par les agents et les succursales de prestataires de services de paiement ayant leur siège social ou leur administration centrale à l’étranger implantés en France, à Saint Pierre-et-Miquelon, en Nouvelle-Calédonie, en Polynésie française ou dans les îles Wallis et Futuna ».
