Article L772-6 of the French Monetary and Financial Code

For application in Saint-Pierre-et-Miquelon:
1° The second paragraph of Article L. 511-10 is replaced by the following provisions:
“Authorisation to operate as a credit institution shall be granted by the Autorité de contrôle prudentiel et de résolution.”;
2° In Article L. 511-15:
a) The first paragraph is replaced by the following provisions: “Withdrawal of authorisation shall be decided by the Autorité de contrôle prudentiel et de résolution at the request of the institution. “;
b) In the second paragraph, the words: “Pursuant to Articles 4 and 14 of Council Regulation (EU) No 1024/2013 of 15 October 2013, this withdrawal may also be decided by the European Central Bank” are replaced by the words: “It may also be decided ex officio by the Authority”.

Pour l’application à Saint-Pierre-et-Miquelon :
1° Le deuxième alinéa de l’article L. 511-10 est remplacé par les dispositions suivantes :
« L’agrément d’établissement de crédit est délivré par l’Autorité de contrôle prudentiel et de résolution. » ;
2° A l’article L. 511-15 :
a) Le premier alinéa est remplacé par les dispositions suivantes : « Le retrait d’agrément est prononcé par l’Autorité de contrôle prudentiel et de résolution à la demande de l’établissement. » ;
b) Au deuxième alinéa, les mots : « En application des articles 4 et 14 du règlement (UE) n° 1024/2013 du Conseil du 15 octobre 2013, ce retrait peut aussi être décidé par la Banque centrale européenne » sont remplacés par les mots : « Il peut aussi être décidé d’office par l’Autorité ».
