Article L775-31 of the French Monetary and Financial Code

I.-The provisions of the articles mentioned in the left-hand column of the following table shall apply in the Wallis and Futuna Islands, subject to the adaptations provided for in II, in the wording indicated in the right-hand column of the same table:

II.-For the application of the articles mentioned in the table above, the first paragraph of Article L. 547-1 shall read as follows:
“Participatory finance service providers are legal entities that, via an Internet information system, put natural or legal persons in contact with each other by granting loans or acquiring securities or instruments accepted for the purposes of participatory finance, and natural or legal persons seeking to obtain finance.
This connection involves either facilitating the granting of loans or placing securities and instruments eligible for participatory financing without a firm commitment and receiving and transmitting client orders for these securities and instruments.

II.-Pour l’application des articles mentionnés dans le tableau ci-dessus premier alinéa de l’article L. 547-1 est ainsi rédigé :
« Les prestataires de services de financement participatif sont les personnes morales qui mettent en relation, par le biais d’un système d’information sur Internet, des personnes physiques ou morales qui octroient des prêts ou acquièrent des valeurs mobilières ou des instruments admis à des fins de financement participatif, et des personnes physiques ou morales qui cherchent à obtenir un financement.
Cette mise en relation implique soit la facilitation de l’octroi de prêts, soit le placement sans engagement ferme de valeurs mobilières et d’instruments admis à des fins de financement participatif et la réception et la transmission d’ordres de clients portant sur ces valeurs et instruments. »
