Article L812-6 of the French Commercial code

The files monitored by the judicial representative or the person mentioned in III of article L. 812-2 who leaves office, for whatever reason, shall be distributed by the court among the other agents or, where the conditions are met, among the persons mentioned in III of Article L. 812-2 within three months of leaving office.

However, in the interests of the proper administration of justice, the court may authorise the former mandatary or the person mentioned in III of Article L. 812-2, to continue handling one or more ongoing cases, unless a striking off is the cause of the discontinuation of his duties. The judicial representative remains subject to the provisions of articles L. 812-8, L. 812-9, L. 812-10, L. 814-1-1 and L. 814-5. The person mentioned in III of article L. 812-2 remains subject to the provisions of III of article L. 812-2, L. 812-8-1, L. 814-1-1, L. 814-10-1, L. 814-10-2 and L. 814-5.

Article L812-6

Les dossiers suivis par le mandataire judiciaire ou la personne mentionnée au III de l’article L. 812-2 qui quitte ses fonctions, pour quelque motif que ce soit, sont répartis par la juridiction entre les autres mandataires ou lorsque les conditions sont remplies, entre les personnes mentionnées au III de l’article L. 812-2 dans un délai de trois mois à compter de la cessation de fonctions.

Toutefois, dans l’intérêt d’une bonne administration de la justice, la juridiction peut autoriser l’ancien mandataire ou la personne mentionnée au III de l’article L. 812-2, à poursuivre le traitement d’un ou de plusieurs dossiers en cours, sauf si une radiation est la cause de l’abandon de ses fonctions. Le mandataire judiciaire demeure soumis aux dispositions des articles L. 812-8, L. 812-9, L. 812-10, L. 814-1-1 et L. 814-5. La personne mentionnée au III de l’article L. 812-2 demeure soumise aux dispositions du III de l’article L. 812-2, L. 812-8-1, L. 814-1-1, L. 814-10-1, L. 814-10-2 et L. 814-5.
