Article L813-1 of the French Code governing the entry and residence of foreign nationals and the right of asylum

If, during a check referred to in article L. 812-2, it appears that a foreign national is unable to prove his right to move or reside in France, he may be detained for the purposes of verifying his right to move or reside on French territory. In this context, the foreign national may be taken to a police or gendarmerie station and held there by a judicial police officer from the national police or gendarmerie.

Article L813-1

Si, à l’occasion d’un contrôle mentionné à l’article L. 812-2, il apparaît qu’un étranger n’est pas en mesure de justifier de son droit de circuler ou de séjourner en France, il peut être retenu aux fins de vérification de son droit de circulation ou de séjour sur le territoire français. Dans ce cadre, l’étranger peut être conduit dans un local de police ou de gendarmerie et y être retenu par un officier de police judiciaire de la police nationale ou de la gendarmerie nationale.
