Article L813-10 of the French Code governing the entry and residence of foreign nationals and the right of asylum

If the foreign national does not provide information enabling an assessment to be made of his/her right to move or reside, the verification operations may give rise, after informing the public prosecutor, to the taking of fingerprints or photographs in order to establish the person’s situation. Fingerprints and photographs are collected with a view to establishing the foreign national’s right to move or reside and may only be stored and be the subject of automated processing pursuant to 3° of article L. 142-1 if it appears, at the end of the detention, that the foreign national does not have a right to move or reside.

Si l’étranger ne fournit pas d’éléments permettant d’apprécier son droit de circulation ou de séjour, les opérations de vérification peuvent donner lieu, après information du procureur de la République, à la prise d’empreintes digitales ou de photographies pour établir la situation de cette personne. Les empreintes digitales et photographies sont collectées en vue de l’établissement du droit de circuler ou de séjourner de l’étranger et ne peuvent être mémorisées et faire l’objet d’un traitement automatisé en application du 3° de l’article L. 142-1 que s’il apparaît, à l’issue de la retenue, que l’étranger ne dispose pas d’un droit de circulation ou de séjour.
