Article L813-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When a foreigner detained for the purposes of verifying his identity pursuant to article 78-3 of the Code of Criminal Procedure is unable to prove his right to move or reside in France, the provisions of article L. 813-1 are applicable.

Article L813-2

Lorsqu’un étranger retenu aux fins de vérification de son identité en application de l’article 78-3 du code de procédure pénale n’est pas en mesure de justifier de son droit de circuler ou de séjourner en France, les dispositions de l’article L. 813-1 sont applicables.
