Article L813-9 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Only for the purposes of verifying the right of movement and residence, the foreign national’s luggage and personal effects may be inspected and searched, under the supervision of the judicial police officer and in the presence of the foreign national, with the latter’s agreement or, failing that, after informing the public prosecutor by any means.
If an offence is discovered, a report shall be drawn up separate from that provided for in the first paragraph of article L. 813-13, which shall mention the place and the dates and times when these operations began and ended, and a copy of which shall be sent without delay to the public prosecutor.

Article L813-9

Pour les seules nécessités de la vérification du droit de circulation et de séjour, il peut être procédé, sous le contrôle de l’officier de police judiciaire et en présence de l’étranger, avec l’accord de ce dernier ou, à défaut, après avoir informé par tout moyen le procureur de la République, à l’inspection des bagages et effets personnels de l’étranger et à leur fouille.
En cas de découverte d’une infraction, il est établi un procès-verbal distinct de celui prévu au premier alinéa de l’article L. 813-13, qui mentionne le lieu et les dates et heures de début et de fin de ces opérations et dont un exemplaire est transmis sans délai au procureur de la République.
