Physical persons convicted under articles L. 823-1, L. 823-2 or L. 823-3 incur the following additional penalties:
1° A residence ban for a maximum of five years;
2° Suspension of the driving licence for a maximum of five years; this period may be doubled in the event of a repeat offence;
3° Temporary or permanent withdrawal of the administrative authorisation to operate either occasional or collective services, or a regular service, or an international transport shuttle service ;<4° Confiscation of the thing that was used or intended to be used to commit the offence, in particular any means of transport or equipment on land, inland waterways, at sea or in the air, or of the thing that is the product of this offence; the costs resulting from the measures required to enforce the confiscation shall be borne by the convicted person and shall be recovered as legal costs;
5° A ban, for a period of up to five years, on exercising the professional or social activity in connection with which the offence was committed, subject to the reservations mentioned in Article 131-27 of the Criminal Code; any breach of this ban shall be punishable by two years’ imprisonment and a fine of €30,000.
