Article LO1112-4 of the French General Code of Local Authorities

The deliberation deciding to organise a local referendum adopted by the deliberative assembly of a territorial community other than the commune is notified, within fifteen days of its receipt, by the State representative to the mayors of the communes located within the jurisdiction of that community, unless his request for suspension has been granted.

The mayors organise the ballot. If a mayor refuses to organise the ballot, the representative of the State shall, after requesting him to do so, do so automatically.

La délibération décidant d’organiser un référendum local adoptée par l’assemblée délibérante d’une collectivité territoriale autre que la commune est notifiée, dans les quinze jours à compter de sa réception, par le représentant de l’Etat aux maires des communes situées dans le ressort de cette collectivité, sauf s’il a été fait droit à sa demande de suspension.

Les maires organisent le scrutin. Si un maire refuse de procéder à cette organisation, le représentant de l’Etat, après l’en avoir requis, y procède d’office.
