Article LO1113-1 of the French General Code of Local Authorities

The law which authorises, on the basis of the fourth paragraph of Article 72 of the Constitution, the territorial authorities to derogate, on an experimental basis, from the legislative provisions governing the exercise of their powers, shall define the purpose of the experiment and its duration, which may not exceed five years, and shall mention the provisions from which derogation may be made.

The law also specifies the categories and characteristics of the local authorities authorised to take part in the experimentation and the cases in which experimentation may be undertaken. It sets the deadline by which territorial authorities that meet the conditions laid down must make their decision to take part in the experiment.

La loi qui autorise, sur le fondement du quatrième alinéa de l’article 72 de la Constitution, les collectivités territoriales à déroger, à titre expérimental aux dispositions législatives régissant l’exercice de leurs compétences, définit l’objet de l’expérimentation ainsi que sa durée, qui ne peut excéder cinq ans, et mentionne les dispositions auxquelles il peut être dérogé.

La loi précise également les catégories et les caractéristiques des collectivités territoriales autorisées à participer à l’expérimentation et les cas dans lesquels l’expérimentation peut être entreprise. Elle fixe le délai dans lequel les collectivités territoriales qui remplissent les conditions fixées prennent leur décision de participer à l’expérimentation.
