Article LO1113-3 of the French General Code of Local Authorities

The representative of the State may request that an appeal against the decision referred to in article LO 1113-2 be suspended; the decision shall then cease to have effect until the administrative court has ruled on the request. If the administrative court has not given a ruling within one month of the matter being referred to it, the resolution becomes enforceable again.
In the event of a request for suspension, the publication in the Official Journal mentioned in the second paragraph of Article LO 1113-2 is deferred until the administrative tribunal has ruled on this request or until the end of the one-month period mentioned in the first paragraph of this article.

Le représentant de l’Etat peut assortir un recours dirigé contre la délibération mentionnée à l’article LO 1113-2 d’une demande de suspension ; cette délibération cesse alors de produire ses effets jusqu’à ce que le tribunal administratif ait statué sur cette demande. Si le tribunal administratif n’a pas statué dans un délai d’un mois suivant sa saisine, la délibération redevient exécutoire.


En cas de demande de suspension, la publication au Journal officiel mentionnée au second alinéa de l’article LO 1113-2 est différée jusqu’à ce que le tribunal administratif ait statué sur cette demande ou jusqu’au terme du délai d’un mois mentionné au premier alinéa du présent article.
