Article LO3445-2 of the French General Code of Local Authorities

I. – A request for authorisation to adapt a legislative or regulatory provision is adopted by reasoned deliberation of the departmental council.

This deliberation mentions the legislative or regulatory provisions in question or, where the request relates to the adaptation of a regulatory provision that has not yet been published and is necessary for the application of a legislative provision, the legislative provision in question.

It sets out the particular characteristics and constraints justifying the request for authorisation and specifies the nature and purpose of the provisions that the departmental council plans to adopt.

The request for authorisation may not relate to one of the matters mentioned in the fourth paragraph of Article 73 of the Constitution, nor intervene when the essential conditions for the exercise of a public freedom or a constitutionally guaranteed right are at stake.

II. – The request for authorisation lapses:

1° On the last day of the month preceding that of the renewal of the departmental councils;

2° On the day of the dissolution of the departmental council that adopted it;

3° On the day of the vacancy of all the seats in the departmental council other than in the case provided for in 2°.

I. – La demande d’habilitation tendant à adapter une disposition législative ou réglementaire est adoptée par délibération motivée du conseil départemental.

Cette délibération mentionne les dispositions législatives ou réglementaires en cause ou, lorsque la demande porte sur l’adaptation d’une disposition réglementaire non encore publiée et nécessaire à l’application d’une disposition législative, la disposition législative en cause.

Elle expose les caractéristiques et contraintes particulières justifiant la demande d’habilitation et précise la nature et la finalité des dispositions que le conseil départemental envisage de prendre.

La demande d’habilitation ne peut porter sur l’une des matières mentionnées au quatrième alinéa de l’article 73 de la Constitution, ni intervenir lorsque sont en cause les conditions essentielles d’exercice d’une liberté publique ou d’un droit constitutionnellement garanti.

II. – La demande d’habilitation devient caduque :

1° Le dernier jour du mois qui précède celui du renouvellement des conseils départementaux ;

2° Le jour de la dissolution du conseil départemental qui l’a adoptée ;

3° Le jour de la vacance de l’ensemble des sièges du conseil départemental en dehors du cas prévu au 2°.
