Article LO3445-5 of the French General Code of Local Authorities

Appeals against this deliberation are referred to the Conseil d’Etat.

The representative of the State in the department may, within one month of the transmission provided for in article LO 3445-4, refer the deliberation to the Conseil d’Etat. This appeal suspends its implementation until the Conseil d’Etat has given its decision. If the decision is not taken within three months of the matter being referred to it, the resolution becomes enforceable once again.

Les recours dirigés contre cette délibération sont portés devant le Conseil d’Etat.

Le représentant de l’Etat dans le département peut, dans le mois qui suit la transmission prévue à l’article LO 3445-4, déférer la délibération au Conseil d’Etat. Ce recours en suspend l’exécution jusqu’à ce que le Conseil d’Etat ait rendu sa décision. Si celle-ci n’est pas intervenue dans un délai de trois mois suivant sa saisine, la délibération redevient exécutoire.
