An overseas collectivity is hereby established to replace the commune of Saint-Barthélemy, the department of Guadeloupe and the region of Guadeloupe on the territory of the island of Saint-Barthélemy and the islets that depend on it and are located less than eight nautical miles from its coastline.
This overseas collectivity, governed by Article 74 of the Constitution, takes the name of: “Saint-Barthélemy”. It is granted autonomy.
The collectivity of Saint-Barthélemy shall be administered freely by its elected representatives and by local referendum, under the conditions laid down by the present code.
The Republic shall guarantee the autonomy of Saint-Barthélemy and respect for its own interests, taking into account its specific geographical and historical features.
