Article LO6213-1 of the French General Code of Local Authorities

Legislative and regulatory provisions are applicable by operation of law to Saint-Barthélemy, with the exception of those relating to matters which fall within the remit of the organic law pursuant to Article 74 of the Constitution or the competence of the local authority pursuant to Article LO 6214-3.

The automatic applicability of laws and regulations does not prevent them from being adapted to the specific organisation of the collectivity of Saint-Barthélemy.

As an exception to the provisions of the first paragraph, the laws and regulations relating to the entry and residence of foreigners and the right of asylum are only applicable to Saint-Barthélemy by express mention.

Les dispositions législatives et réglementaires sont applicables de plein droit à Saint-Barthélemy, à l’exception de celles intervenant dans les matières qui relèvent de la loi organique en application de l’article 74 de la Constitution ou de la compétence de la collectivité en application de l’article LO 6214-3.

L’applicabilité de plein droit des lois et règlements ne fait pas obstacle à leur adaptation à l’organisation particulière de la collectivité de Saint-Barthélemy.

Par dérogation aux dispositions du premier alinéa, les lois et règlements relatifs à l’entrée et au séjour des étrangers ainsi qu’au droit d’asile ne sont applicables à Saint-Barthélemy que sur mention expresse.
