Article LO6213-2 of the French General Code of Local Authorities

I. – Laws and, when they are published in the Official Journal of the French Republic, administrative acts come into force in Saint-Barthélemy on the date they set or, failing that, the day after their publication. However, the entry into force of those of their provisions whose execution requires implementing measures shall be postponed until the date of entry into force of those measures.

In the event of an emergency, laws whose promulgation decree so prescribes and administrative acts for which the Government so orders by a special provision shall enter into force as soon as they are published.

This I shall not apply to individual acts.

II. – The publication of laws, ordinances, decrees and, where provided for by a law, ordinance or decree, other administrative acts is ensured in electronic form, under conditions that guarantee their authenticity. The Official Journal of the French Republic is made available to the public in electronic form permanently and free of charge. When a person requests a paper copy of a document published in the Official Journal of the French Republic, the administration will provide the corresponding extract. The administration is not obliged to comply with requests that are abusive, in particular because of their number or their repetitive or systematic nature.

III. – The regulatory provisions in force in mainland France which define the individual acts which must be published under conditions which guarantee that they are not subject to indexing by search engines are applicable as of right to Saint-Barthélemy.

IV. – In Saint-Barthélemy, the publication of administrative acts and documents in the official bulletin of a Ministry, distributed in electronic form under conditions guaranteeing its reliability, produces the same legal effects as their publication in printed form.

I. – Les lois et, lorsqu’ils sont publiés au Journal officiel de la République française, les actes administratifs entrent en vigueur à Saint-Barthélemy à la date qu’ils fixent ou, à défaut, le lendemain de leur publication. Toutefois, l’entrée en vigueur de celles de leurs dispositions dont l’exécution nécessite des mesures d’application est reportée à la date d’entrée en vigueur de ces mesures.

En cas d’urgence, entrent en vigueur dès leur publication les lois dont le décret de promulgation le prescrit et les actes administratifs pour lesquels le Gouvernement l’ordonne par une disposition spéciale.

Le présent I n’est pas applicable aux actes individuels.

II. – La publication des lois, des ordonnances, des décrets et, lorsqu’une loi, une ordonnance ou un décret le prévoit, des autres actes administratifs est assurée sous forme électronique, dans des conditions de nature à garantir leur authenticité. Le Journal officiel de la République française est mis à la disposition du public sous forme électronique de manière permanente et gratuite. Lorsqu’une personne demande à obtenir sur papier un acte publié au Journal officiel de la République française, l’administration lui communique l’extrait correspondant. L’administration n’est pas tenue de donner suite aux demandes abusives, en particulier par leur nombre ou par leur caractère répétitif ou systématique.

III. – Sont applicables de plein droit à Saint-Barthélemy les dispositions réglementaires en vigueur en métropole qui définissent les actes individuels devant être publiés dans des conditions garantissant qu’ils ne font pas l’objet d’une indexation par des moteurs de recherche.

IV. – A Saint-Barthélemy, la publication des actes et documents administratifs au bulletin officiel d’un ministère, diffusé sous forme électronique dans les conditions garantissant sa fiabilité, produit les mêmes effets de droit que leur publication sous forme imprimée.
