Article LO6221-16 of the French General Code of Local Authorities

Votes are taken by open ballot whenever one-sixth of the members present so request. In the event of a tie, the chairman shall have the casting vote.

Votes on appointments are always taken by secret ballot. However, the Territorial Council may unanimously decide not to proceed by secret ballot with appointments or presentations, unless legislative or regulatory provisions expressly provide for this method of voting.

The results of public ballots, stating the names of those voting, are reproduced in the minutes.

Les votes sont recueillis au scrutin public toutes les fois que le sixième des membres présents le demande. En cas de partage égal, la voix du président est prépondérante.

Les votes sur les nominations ont toujours lieu au scrutin secret. Toutefois, le conseil territorial peut décider, à l’unanimité, de ne pas procéder au scrutin secret aux nominations ou aux présentations, sauf disposition législative ou réglementaire prévoyant expressément ce mode de scrutin.

Le résultat des scrutins publics, énonçant les noms des votants, est reproduit au procès-verbal.
