Article LO6222-3 of the French General Code of Local Authorities

The functions of President of the Territorial Council are incompatible with the exercise of any other non-elective public function.

The functions of President of the Territorial Council are also incompatible with those of member of the European Commission, member of the Executive Board of the European Central Bank or member of the Monetary Committee of the Banque de France.

The President of the Territorial Council who holds a position that places him or her in a situation of incompatibility provided for by the two preceding paragraphs has a period of one month in which to choose to exercise his or her duties as President of the Territorial Council. In the event of a dispute, the incompatibility takes effect from the date on which the court decision confirming the election becomes final.

Les fonctions de président du conseil territorial sont incompatibles avec l’exercice de toute autre fonction publique non élective.

Les fonctions de président du conseil territorial sont également incompatibles avec celles de membre de la Commission européenne, de membre du directoire de la Banque centrale européenne ou de membre du comité monétaire de la Banque de France.

Le président du conseil territorial exerçant une fonction le plaçant dans une situation d’incompatibilité prévue par les deux alinéas précédents dispose d’un délai d’un mois pour choisir d’exercer ses fonctions de président du conseil territorial. En cas de contestation, l’incompatibilité prend effet à compter de la date à laquelle la décision juridictionnelle confirmant l’élection devient définitive.
