Article LO6222-9 of the French General Code of Local Authorities

The president of the territorial council and the members of the executive council, after having been heard or invited to provide written explanations on the facts of which they are accused, may be suspended by reasoned order of the minister responsible for overseas France for a period not exceeding one month. They may only be removed from office by a reasoned decree issued in the Council of Ministers.

Removal from office automatically entails ineligibility for the offices of President of the Territorial Council and for those of member of the Executive Council for a period of one year from the date of the decree of removal from office, unless a full renewal of the Territorial Council is carried out beforehand.

Appeals against the decrees provided for in this article shall be brought before the Conseil d’Etat ruling on contentious matters.

Le président du conseil territorial et les membres du conseil exécutif, après avoir été entendus ou invités à fournir des explications écrites sur les faits qui leur sont reprochés, peuvent être suspendus par arrêté motivé du ministre chargé de l’outre-mer pour une durée qui n’excède pas un mois. Ils ne peuvent être révoqués que par décret motivé pris en conseil des ministres.

La révocation emporte de plein droit l’inéligibilité aux fonctions de président du conseil territorial et à celles de membre du conseil exécutif pendant une durée d’un an à compter du décret de révocation, à moins qu’il ne soit procédé auparavant au renouvellement intégral du conseil territorial.

Les recours contre les arrêtés prévus au présent article sont portés devant le Conseil d’Etat statuant au contentieux.
