Article LO6223-3 of the French General Code of Local Authorities

I. – The Economic, Social, Cultural and Environmental Council is consulted by the Territorial Council on the preparation and implementation of the Nation’s plan in the collectivity, on the distribution and use of State appropriations intended for investments of interest to the collectivity, on the preparation of the sustainable development and development plan for Saint-Barthélemy, as well as on the general guidelines of the draft budget of the collectivity.

The Economic, Social, Cultural and Environmental Council gives its opinion on the results of their implementation.

II. – The Economic, Social, Cultural and Environmental Council is consulted:

1° On draft and proposed acts of the Territorial Council of an economic, social, cultural and environmental nature;

2° On draft and proposed deliberations setting the main guidelines for the island’s economic, social, cultural and environmental development, including sustainable development.

III. – It has a period of time in which to give its opinion:

1° In the cases provided for in I and 2° of II, of one month, reduced to fifteen days in the event of an emergency declared by the President of the Territorial Council;

2° In the case provided for in 1° of the same II, of twelve clear days, reduced to one clear day in the event of an emergency declared by the President of the Territorial Council.

On expiry of this period, the opinion is deemed to have been given.

IV. – By a two-thirds majority of its members, the Economic, Social, Cultural and Environmental Council decides to carry out studies on matters within its remit.

It may also, on its own initiative, give its opinion on any proposed deliberation.

It may also be asked for its opinion by the representative of the State in economic, social, cultural or environmental matters.

V. – The reports and opinions of the Economic, Social, Cultural and Environmental Council are made public.

I. – Le conseil économique, social, culturel et environnemental est consulté par le conseil territorial sur la préparation et l’exécution du plan de la Nation dans la collectivité, sur la répartition et l’utilisation des crédits de l’Etat destinés à des investissements intéressant la collectivité, sur la préparation du plan d’aménagement et de développement durable de Saint-Barthélemy, ainsi que sur les orientations générales du projet de budget de la collectivité.

Le conseil économique, social, culturel et environnemental donne son avis sur les résultats de leur mise en oeuvre.

II. – Le conseil économique, social, culturel et environnemental est consulté :

1° Sur les projets et propositions d’actes du conseil territorial à caractère économique, social, culturel et environnemental ;

2° Sur les projets et propositions de délibérations fixant les principales orientations du développement économique, social, culturel et environnemental de l’île, y compris en matière de développement durable.

III. – Il dispose pour donner son avis d’un délai :

1° Dans les cas prévus aux I et 2° du II, d’un mois, ramené à quinze jours en cas d’urgence déclarée par le président du conseil territorial ;

2° Dans le cas prévu au 1° du même II, de douze jours francs, ramené à un jour franc en cas d’urgence déclarée par le président du conseil territorial.

A l’expiration de ce délai, l’avis est réputé rendu.

IV. – A la majorité des deux tiers de ses membres, le conseil économique, social, culturel et environnemental décide de réaliser des études sur des questions relevant de ses compétences.

Il peut également, à son initiative, donner son avis sur toute proposition de délibération.

Il peut également être saisi pour avis par le représentant de l’Etat en matière économique, sociale, culturelle ou environnementale.

V. – Les rapports et avis du conseil économique, social, culturel et environnemental sont rendus publics.
