I. – The Territorial Council may submit to a referendum any draft or proposed deliberation tending to regulate a matter within its competence, with the exception, on the one hand, of the opinions which it is called upon to give on draft and proposed legislation and on draft ordinances, and on the other hand, of the proposals which it may adopt within the framework of Articles LO 6251-12, LO 6251-14 and LO 6251-15.
II. – On a proposal from the Executive Council, the Territorial Council may submit to a referendum any draft regulatory act falling within the remit of the President of the Territorial Council or the Executive Council.
III. – Articles LO 1112-3, LO 1112-5 (first paragraph) and LO 1112-6 to LO 1112-14 are applicable to local referendums organised by the collectivity of Saint-Barthélemy.
The provisions of the electoral code referred to in articles LO 1112-9 to LO 1112-13 of the present code are applicable under the conditions laid down by Chapter I of Title II of Book VI of the Electoral Code.
