Article LO6241-3 of the French General Code of Local Authorities

Acts taken in the name of the collectivity and other than those mentioned in article LO 6241-2 are enforceable by operation of law as soon as they have been published in the Official Journal of Saint-Barthélemy, posted or notified to the interested parties.

The representative of the State may request that they be communicated at any time. He may only refer them to the administrative court, within a period of two months from their communication, if his request was presented within the period of two months from the date on which the acts became enforceable.

Les actes pris au nom de la collectivité et autres que ceux mentionnés à l’article LO 6241-2 sont exécutoires de plein droit dès qu’il a été procédé à leur publication au Journal officiel de Saint-Barthélemy, à leur affichage ou à leur notification aux intéressés.

Le représentant de l’Etat peut en demander communication à tout moment. Il ne peut les déférer au tribunal administratif, dans un délai de deux mois à compter de leur communication, que si sa demande a été présentée dans le délai de deux mois à compter de la date à laquelle les actes sont devenus exécutoires.
