Article LO6243-2 of the French General Code of Local Authorities

Appeals by the representative of the State against the acts mentioned in article LO 6243-1, formed in accordance with the procedures set out in articles LO 6242-1 and LO 6242-2, are also brought before the Conseil d’Etat.

When the representative of the State accompanies an appeal against an act with a request for suspension, made within the fifteen-day period provided for in article LO 6241-1, this act may not enter into force until the Conseil d’Etat has ruled on this request. If the Conseil d’Etat has not given its decision within three months of the matter being referred to it, the act becomes enforceable again. The provisions of this paragraph do not apply to tax matters.

Les recours du représentant de l’Etat contre les actes mentionnés à l’article LO 6243-1, formés selon les modalités prévues aux articles LO 6242-1 et LO 6242-2, sont également portés devant le Conseil d’Etat.

Lorsque le représentant de l’Etat assortit un recours dirigé contre un acte d’une demande de suspension, formulée dans le délai de quinze jours prévu à l’article LO 6241-1, cet acte ne peut entrer en vigueur jusqu’à ce que le Conseil d’Etat ait statué sur cette demande. Si le Conseil d’Etat n’a pas rendu sa décision dans un délai de trois mois suivant sa saisine, l’acte redevient exécutoire. Les dispositions du présent alinéa ne sont pas applicables en matière fiscale.
