Article LO6313-1 of the French General Code of Local Authorities

Legislative and regulatory provisions shall apply ipso jure in Saint-Martin, with the exception of those intervening in matters which fall within the remit of the organic law pursuant to Article 74 of the Constitution or within the remit of the collectivity pursuant to Article LO 6314-3.

The automatic applicability of laws and regulations does not prevent them from being adapted to the particular organisation of Saint-Martin.

By way of derogation from the provisions of the first paragraph, the laws and regulations relating to the entry and residence of foreigners and the right of asylum are only applicable to Saint-Martin by express mention.

Les dispositions législatives et réglementaires sont applicables de plein droit à Saint-Martin, à l’exception de celles intervenant dans les matières qui relèvent de la loi organique en application de l’article 74 de la Constitution ou de la compétence de la collectivité en application de l’article LO 6314-3.

L’applicabilité de plein droit des lois et règlements ne fait pas obstacle à leur adaptation à l’organisation particulière de Saint-Martin.

Par dérogation aux dispositions du premier alinéa, les lois et règlements relatifs à l’entrée et au séjour des étrangers ainsi qu’au droit d’asile ne sont applicables à Saint-Martin que sur mention expresse.
