Article LO6321-5 of the French General Code of Local Authorities

When the functioning of the Territorial Council proves impossible, the Government may pronounce its dissolution, ex officio or at the request of its President, by a reasoned decree issued in the Council of Ministers.

The dissolution decree sets the date for new elections. The Government shall inform Parliament of this as soon as possible.

If there is an emergency, the Territorial Council may be temporarily suspended by reasoned decree of the Minister responsible for Overseas France. The duration of the suspension may not exceed one month.

Lorsque le fonctionnement du conseil territorial se révèle impossible, le Gouvernement peut en prononcer la dissolution, d’office ou à la demande de son président, par décret motivé pris en Conseil des ministres.

Le décret de dissolution fixe la date des nouvelles élections. Le Gouvernement en informe le Parlement dans le délai le plus bref.

S’il y a urgence, le conseil territorial peut être provisoirement suspendu par arrêté motivé du ministre chargé de l’outre-mer. La durée de la suspension ne peut excéder un mois.
