Article LO6322-1 of the French General Code of Local Authorities

The Territorial Council elects its chairman at the meeting held as of right following each renewal.

For this election, it is chaired by its oldest member, with the youngest member acting as secretary.

In this case, the Territorial Council may only deliberate if two-thirds of its members are present. If this condition is not met, the meeting is held automatically three days later. The meeting may then take place without a quorum being required.

The President is elected by an absolute majority of the members of the Territorial Council for the duration of the Territorial Council’s term of office. If this election is not obtained after the first two ballots, a third ballot shall be held and the election shall take place by a relative majority of the members of the Territorial Council. In the event of a tie, the election is won on the basis of age.

Le conseil territorial élit son président lors de la réunion de droit qui suit chaque renouvellement.

Pour cette élection, il est présidé par son doyen d’âge, le plus jeune membre faisant fonction de secrétaire.

Le conseil territorial ne peut dans ce cas délibérer que si les deux tiers de ses membres sont présents. Si cette condition n’est pas remplie, la réunion se tient de plein droit trois jours plus tard. La réunion peut alors avoir lieu sans condition de quorum.

Le président est élu à la majorité absolue des membres du conseil territorial pour la durée du mandat du conseil territorial. Si cette élection n’est pas acquise après les deux premiers tours de scrutin, il est procédé à un troisième tour de scrutin et l’élection a lieu à la majorité relative des membres du conseil territorial. En cas d’égalité des voix, l’élection est acquise au bénéfice de l’âge.
