Article LO6322-16 of the French General Code of Local Authorities

When the functioning of the Executive Council proves impossible, the Government may, on its own initiative or at the request of the President of the Territorial Council, pronounce its dissolution by reasoned decree issued in the Council of Ministers, after consulting the Territorial Council.

The dissolution decree sets the date of the elections, which shall take place within ten days. Parliament is notified of the decree. The Territorial Council is convened by the representative of the State to proceed with this election.

If there is an emergency, the Executive Council may be temporarily suspended by reasoned order of the minister responsible for overseas France. The duration of the suspension may not exceed one month.

In the event of dissolution or suspension of the Executive Council pursuant to this article, the President of the Territorial Council shall be responsible for conducting current business. His/her decisions shall only be enforceable with the agreement of the representative of the State.

Lorsque le fonctionnement du conseil exécutif se révèle impossible, le Gouvernement peut, d’office ou à la demande du président du conseil territorial, en prononcer la dissolution par décret motivé pris en conseil des ministres, après avis du conseil territorial.

Le décret de dissolution fixe la date des élections, qui ont lieu dans un délai de dix jours. Il est porté à la connaissance du Parlement. Le conseil territorial est convoqué par le représentant de l’Etat pour procéder à cette élection.

S’il y a urgence, le conseil exécutif peut être provisoirement suspendu par arrêté motivé du ministre chargé de l’outre-mer. La durée de la suspension ne peut excéder un mois.

En cas de dissolution ou de suspension du conseil exécutif en application du présent article, le président du conseil territorial est chargé de l’expédition des affaires courantes. Ses décisions ne sont exécutoires qu’avec l’accord du représentant de l’Etat.
