Article LO6325-3 of the French General Code of Local Authorities

The territorial councillor who holds other electoral mandates or who sits in this capacity on the board of directors of a local public establishment or of the Centre national de la fonction publique territoriale, on the board of directors or supervisory board of a local semi-public company or who chairs such a company may not receive, for all their duties, a total amount of remuneration and allowances exceeding one and a half times the amount of the parliamentary allowance as defined in Article 1 of the Order no. 58-1210 of 13 December 1958 on the Organic Law on the Allowances of Members of Parliament. This ceiling is net of compulsory social security contributions.

When, in application of the provisions of the first paragraph, the total amount of a territorial councillor’s remuneration and functional allowances is subject to capping, the capped portion is repaid to the budget of the public body within which the territorial councillor most recently held a mandate or function.

Le conseiller territorial titulaire d’autres mandats électoraux ou qui siège à ce titre au conseil d’administration d’un établissement public local ou du Centre national de la fonction publique territoriale, au conseil d’administration ou au conseil de surveillance d’une société d’économie mixte locale ou qui préside une telle société ne peut percevoir, pour l’ensemble de ses fonctions, un montant total de rémunérations et d’indemnités de fonction supérieur à une fois et demie le montant de l’indemnité parlementaire telle qu’elle est définie à l’article 1er de l’ordonnance n° 58-1210 du 13 décembre 1958 portant loi organique relative à l’indemnité des membres du Parlement. Ce plafond s’entend déduction faite des cotisations sociales obligatoires.

Lorsque, en application des dispositions du premier alinéa, le montant total des rémunérations et des indemnités de fonction d’un conseiller territorial fait l’objet d’un écrêtement, la part écrêtée est reversée au budget de la personne publique au sein de laquelle le conseiller territorial exerce le plus récemment un mandat ou une fonction.
