Article LO6351-3 of the French General Code of Local Authorities

I. – The Territorial Council is empowered, in compliance with the guarantees granted throughout the national territory for the exercise of public freedoms, to adopt acts in the field of criminal law for the sole purposes mentioned in Article LO 6314-5. These acts must respect the classification of contraventions and délits. The penalties they establish may not exceed the maximum provided for offences of the same nature by the laws and regulations in force.

The draft or proposed act mentioned in the first paragraph is forwarded by the President of the Territorial Council to the Minister responsible for Overseas Territories, who acknowledges receipt without delay.As from this receipt, this Minister and the Minister of Justice shall propose to the Prime Minister, within a period of two months, a draft decree either for the total or partial approval of the text, or for the refusal of approval.

Reasons shall be given for the decree refusing approval. It shall be notified to the President of the Territorial Council.

The draft or proposed act may only be adopted by the Territorial Council in the same terms.

Where they relate to an act that falls within the scope of the law, the decrees provided for in the second paragraph may not come into force before they have been ratified by the law.

The acts provided for in this article may be amended respectively by a law or an ordinance or by a decree that includes an express mention of application to Saint-Martin.

II. – Under the conditions provided for in I, the territorial council is empowered to adopt acts in the field of maritime police and safety.

Individual decisions taken in application of the acts mentioned in the first paragraph of this II are subject to the hierarchical control of the representative of the State. Their entry into force is subject to their receipt by the representative of the State.

I. – Le conseil territorial est habilité, dans le respect des garanties accordées sur l’ensemble du territoire national pour l’exercice des libertés publiques, à adopter des actes dans le domaine du droit pénal aux seules fins mentionnées à l’article LO 6314-5. Ces actes doivent respecter la classification des contraventions et délits. Les peines qu’ils instituent ne peuvent excéder le maximum prévu pour les infractions de même nature par les lois et règlements en vigueur.

Le projet ou la proposition d’acte mentionné au premier alinéa est transmis par le président du conseil territorial au ministre chargé de l’outre-mer qui en accuse réception sans délai.A compter de cette réception, ce ministre et le ministre de la justice proposent au Premier ministre, dans le délai de deux mois, un projet de décret tendant soit à l’approbation totale ou partielle du texte, soit au refus d’approbation.

Le décret qui porte refus d’approbation est motivé. Il est notifié au président du conseil territorial.

Le projet ou la proposition d’acte ne peut être adopté par le conseil territorial que dans les mêmes termes.

Lorsqu’ils portent sur un acte intervenant dans le domaine de la loi, les décrets prévus au deuxième alinéa ne peuvent entrer en vigueur avant leur ratification par la loi.

Les actes prévus au présent article peuvent être respectivement modifiés par une loi ou une ordonnance ou par un décret qui comporte une mention expresse d’application à Saint-Martin.

II. – Dans les conditions prévues au I, le conseil territorial est habilité à adopter des actes dans le domaine de la police et de la sécurité maritimes.

Les décisions individuelles prises en application des actes mentionnés au premier alinéa du présent II sont soumises au contrôle hiérarchique du représentant de l’Etat. Leur entrée en vigueur est subordonnée à leur réception par le représentant de l’Etat.
